في غمرة اهتمامي بكتابة هذه السلسلة عن حقوقنا السيادية، لفتت انتباهي الدراسة (المرفقة بصيغة PDF المؤلفة من 28 صفحة)، والتي أعدها الباحث (حيدر عواد محمد)، وهو طالب ماجستير في كلية القانون / جامعة ذي قار، بعنوان (أثر منطقة فشت العيك على تحديد الحدود البحرية العراقية الكويتية). .
وقد لمست في هذه الدراسة الحس الوطني لهذا الرجل، في حين نادراً ما نجد مثل هذا الاهتمام عند بعض العاملين في البحر. .
يتحدث هذا الطالب عن مقتربات خور عبد اللة، وكأنه كان يعمل معنا، ويرافقنا اثناء إرشادنا للسفن المتوجهة إلى ميناء أم قصر، مشيرا في دراسته إلى الوضع الجغرافي والقانوني للخور باعتباره من المسطحات المائية الضحلة, وغير المرسمة حدوديا في المقطع الذي يلي الدعامة 162 المثبتة بموجب قرار مجلس الأمن 833 لسنة 1993. .
يتناول الباحث في دراسته منطقة فشت العيك، ومساعي الكويت لتحويلها الى جزيرة محاذية للقناة بغية الانطلاق منها لمد خط الأساس نحو سواحل الفاو، ظناً منها ان هذه الخطوة تتماشى مع مفهوم المادة الحادية عشرة من إتفاقية جنيف للبحر الاقليمي 1958, وظناً منها أنها تتناغم مع المادة 13 من إتفاقية الأمم المتحدة لقانون البحار 1982, حيث أجازت المادة الثانية من المرسوم 1967 إستخدام الحافة الخارجية لتلك المرتفعات لرسم خط الأساس في الجزر الادنى، وتعكس هذه الخطوة مساعي الكويت لبناء منصة مرفئية هناك عام 2018، وقد هرعت الكويت بالفعل لتسجيلها لدى المنظمة البحرية الدولية (IMO)، ونجحت في تثبيتها كجزيرة على الخرائط الادميرالية. .
يرى الباحث ان الحكومات السابقة والحالية كانت مهملة ومقصرة في هذا الملف، على الرغم من أنها أدركت متأخرة حجم الأضرار المترتبة على اهمالها وتقصيرها. .
لا شك ان استثمار الكويت لمنطقة فشت العيك، واندفاعها نحو سواحل الفاو، وتشييدها لهذه المحطة الساحلية المتقدمة، والمتاخمة للممر الملاحي المؤدي إلى موانئ أم قصر، ستترك تداعياتها المستقبلية الخطيرة على حقوقنا الملاحية، الأمر الذي دفع الحكومة العراقية إلى تقديم مذكرة احتجاج إلى مجلس الأمن بتاريخ 7 / 8 / 2019، والاعتراض رسميا على المنصة البحرية، التي أقامتها الكويت فوق (فشت العيك), واعتبارها من الخروقات والانتهاكات الحدودية المؤثرة على ترسيم الحدود البحرية بين البلدين, وقد طلبت الحكومة العراقية من الأمم المتحدة توثيق احتجاجها الرسمي على ما أسمته : (قيام حكومة الكويت بإحداث تغيرات جغرافية في المنطقة البحرية الواقعة بعد الدعامة 162 في خور عبد الله من خلال تدعيم منطقة ضحلة – فشت العيك – واقامة منصات مرفئية عليها من طرف واحد، ودون علم وموافقة العراق). معتبرة ان الخطوة الكويتية لا أساس لها من النواحي القانونية. .
ويرى الباحث: ان إعتماد الكويت على فشت العيك في قياس بحرها الإقليمي سوف يؤدي إلى آثار كارثية على المياه الإقليمية العراقية, وسيؤدي ذلك الى استحواذها على أجزاء كبيرة من البحر الإقليمي العراقي، ومصادرتها بدون وجه حق، وضمها إلى المياه الكويتية، وسيصبح العراق بلا منفذ سيادي على الخليج العربي. .
ختاماً نرفع القبعة لهذا الرجل الوطني وللأساتذة الذين أشرفوا على دراسته في جامعة ذي قار. .
