في الدستور العراقي …النفط ملك الشعب وراتب و قطعة أرض لكل عراقي المادة (30) و المادة (111) …

بقلم المهندس :- حيدر عبدالجبار البطاط ..

المادة (30)
اولاً: تكفل الدولة للفرد وللاسرة ـ وبخاصة الطفل والمرأة ـ الضمان الاجتماعي والصحي !
والمقومات الاساسية للعيش في حياةٍ حرة كريمةٍ !
تؤمن لهم الدخل المناسب !
والسكن الملائم .
هذا يعني ان واجب الحكومة توفير عمل و قطعة ارض مجانية لكل مواطن ؟؟
لان الارض و ما عليها و ما في باطنها هي ملك الشعب و ليس ملك للحكومة.
و الحكومة تتولى ادارة تنظيم الخدمات للشعب فقط ؟

و قد جاء في تصريح الحكومة العراقية الاخير ان عدد المشمولين بالرعايه الاجتماعيه 2.1 مليون أسرة
و إذا ما قلنا ان عدد الأسرة الواحدة يتكون من سبع اشخاص !!
و عدد نفوس العراق 43 مليون مواطن !!
فهذا يعني ان مجموع عدد الأسر في العراق يبلغ 6 مليون أسرة !!
و من ما جاء أعلاه يتبين لنا ان ‎%‎33 من الشعب العراقي يستلمون راتب رعاية اي انهم تحت خط الفقر !!

و ان عداد كبيرة من النسبة المتبقية لا يملكون رعاية و لا يستلمون راتب
وإذا قدرنا نسبتهم ‎%‎47
هذا يعني أن عدد الفقراء يصل إلى ‎‎%‎80
بدون راتب و بدون اعانة
و هذا موشر خطير جدا بحق الانسانية

و من ما جاء أعلاه وفي هذا الشهر الفضيل
أطلق مناشدة للجهات المعنية التحرك من اجل إنقاذ هذه الفئات من الشعب التي تشكل النسبة العظيمة من الدمار و الضياع ؟؟

المادة (111)
نصت المادة (111) من دستور 2005 التي عالجت ملكية النفط والغاز في العراق على
ان : ((النفط والغاز هو ملك الشعب العراقي في الأقاليم والمحافظات.))
ان هذا النص ينسجم مع اتجاه القانون الدولي العام، الذي يعد الثروات الطبيعية ملك الشعوب، وليست ملك الحكام !!
وان الدولة ما هي الا اداة للإدارة والتوزيع والتطوير !!
وهذا ما أكدته عليه قرارات منظمة الأمم المتحدة، ومنها قرارها المرقم 1803 في 14/12/1962
تحت عنوان (السيادة الدائمة على الموارد الطبيعية)، الذي أكد وجوب احترام حق الشعوب والأمم في السيادة الدائمة على ثرواتها ومواردها الطبيعية وفقا لمصلحة تنميتها القومية ورفاه شعب الدولة المعنية
كما أكد القرار على مراعاة حسن النية في امتثال الدول للإتفاقيات المتعلقة بالاستثمار الاجنبي بشأن الموارد الطبيعية.
ومنذ ذلك الحين تؤكد المواثيق والعهود والإتفاقات الدولية على حق الشعوب في سعيها وراء تحقيق أهدافها الخاصة وذلك من خلال التصرف الحر في ثرواتها ومواردها الطبيعية
ولا يجوز، في اي حال من الاحوال، حرمان اي شعب من أسباب عيشه الخاصة ورفاهيته.

و اخيراً قرار المحكمة الاتحادية العليا المرقم 59 / اتحادية / 2012 وموحدتها 110 / اتحادية / 2019
الذي ينص ما يلي
تجد المحكمة الاتحادية العليا : – إن النفط والغاز في جميع أنحاء العراق هو ملك للشعب العراقي، ولا يجوز لأية سلطة اتحادية أو السلطات المحلية للأقاليم والمحافظات تجاوز ذلك، والامر الذي يقتضي توزيع عادل ومتساوي لعائدات النفط والغاز على جميع أبناء الشعب العراقي  بغض النظر عن مناطق إلانتاج !!
و من هذا النص نجد ( توزيع عادل و متساوي لعائدات النفط و الغاز على جميع ابناء الشعب العراقي )
وأنا اناشد اين العدالة … و النسبة الأكبر من ابناء شعبنا المظلومين في حالة فقر و عوز .
و بالمقابل أفراد قليلين يتمتعون بثروات البلاد التي منّ الله بها على الفقراء و المحرومين و سرقها منهم الظلام و الفاسدين .
