محور نظرية الحكم في دولنا يدور حول مصطلح الراسخون في العلم التي وردت في الاية المباركة[هُوَ الَّذِي أَنزَلَ عَلَيْكَ الْكِتَابَ مِنْهُ آيَاتٌ مُّحْكَمَاتٌ هُنَّ أُمُّ الْكِتَابِ وَأُخَرُ مُتَشَابِهَاتٌ ۖ فَأَمَّا الَّذِينَ فِي قُلُوبِهِمْ زَيْغٌ فَيَتَّبِعُونَ مَا تَشَابَهَ مِنْهُ ابْتِغَاءَ الْفِتْنَةِ وَابْتِغَاءَ تَأْوِيلِهِ ۗ وَمَا يَعْلَمُ تَأْوِيلَهُ إِلَّا اللَّهُ ۗ وَالرَّاسِخُونَ فِي الْعِلْمِ يَقُولُونَ آمَنَّا بِهِ كُلٌّ مِّنْ عِندِ رَبِّنَا ۗ وَمَا يَذَّكَّرُ إِلَّا أُولُو الْأَلْبَابِ (ال عمران-7)]
حيث ثبت الله تبارك وتعالى بأن الرجوع في كل ماموجود في القران الكريم؛يكون لمجموعة اشخاص(الراسخون) ممن يصنفون ضمن اصحاب العقول الراجحة الفعالة المنتجة وليس فرد وهناك ثلاثة اراء في تحديد الراسخون في العلم:
١-الاجتماع المكاني للفقهاء وحصرها بالفقه دون المعارف والعلوم الأخرى فلذلك يكون يكون الراسخون في العلم مجموعة من الفقهاء ليكون اتفاقهم حجة على الحاكم والمحكوم.
٢-انتقال اراء مجموعة الفقهاء المكانية عبر الزمان تحت عنوان الشياع والإجماع الفقهي فيوصف(الاجتماع المكاني العابر للأزمنة).
٣-ان يكون الفقيه واحد من مجموعة المفكرين والمختصين في مختلف العلوم ويخرج منهم في مكان وزمان ما (حسب الدولة) وهذا الرأي قابل للتغيير من مكان لاخر في زمان واحد او عند ظهور ادلة علمية جديدة وافكار اخرى غير التي ينتجها مفكري زمان من الازمنة.
إن رجحان الرأي الثالث ياتي من عدة جوانب ويملك عدة نقاط مفاضلة في جانبه وهذا يؤدي إلى عدم تعارض الشرائع السماوية مع انتاج الدولة المدنية ويحيد الاراء التي تقاتل من اجل قيام الدولة الدينية تحت مسمى دولة الخلافة او ولاية الفقيه.
