حسمت وزارة المالية و بكتابها المرقم ٧٤٩٤ في ٢٠٢١/٣/٩ ( قبل يوم ) حيث قطعت الطريق على اجتهادات الوزارات والدوائر فيما يتعلق بترفيع الموظفين و انصفت الموظف حيث تضمن كتابها ما يلي :-
١- ان ترفيع الموظف من تاريخ استحقاقه الترفيع و ليس من تاريخ صدور الامر الاداري .
٢- لا يشترط توفر درجة شاغرة لغرض ترفيع الموظف اليها بل يمكن من خلال اجراء حذف و استحداث لنفس درجة الموظف .
٣- لا يتعلق الترفيع باقرار الموازنة بل يمكن اجراءه حتى مع تاخر اقرار الموازنة و ضمن باب صرف ١٢/١ اذا توفر التخصيص المالي ضمن هذا الباب …

مما يتطلب ضرورة اعلام السلطة التشريعية و السلطة القضائية و الادعاء العام و المحكمة الاتحادية العليا و حسب نص الفقرة 3 من اختصاصاتها و مجلس الدولة محكمة قضاء الموظفين وهيئة النزاهة العامة و المفوضية العليا لحقوق الانسان ولكونهم جهة من ضمن اختصاصاتهم مراقبة تطبيق القوانين لذا يتطلب تقديم الطعن في كافة المخالفات القانونية التي تحصل من السلطة التنفيذية و الوزارات المختصة لديهم و العمل على عدم ضياع الحقوق و ضرورة احترام و تطبيق القوانين بشكل صحيح من السلطة التنفيذية و الادارية .
