.1. تفعيل بعض النصوص القانونية النافذة لغاية تاريخه مثال على ذلك احكام الفقرة (ز) من المادة (2) من ( قانون بشان معاقبة المتامرين على سلامة الوطن ومفسدي نظام الحكم ) رقم (7) لسنة 1958 (النافذ) والتي نصت على :
يعتبر مفسدا لنظام الحكم كل من كان موظفا عاما وزيرا او غيره وكل من كان عضوا في مجلس الامن او مجلس امانة العاصمة او المجالس البلدية او الادارية على اختلاف انواعها وعلى العموم كل شخص كان مكلفا بخدمة عامة ارتكب او شارك في ارتكاب امر من الأمور الاتية :
ز – تبديد الثروة القومية بصرف نفقات لا تقتضيها طبيعة المشاريع أو التعامل المتعارف عليه او لا تتناسب مع كلفتها الحقيقية او بالصرف على مشاريع وهمية او غير ضرورية او تعريض اموال الدولة للتلف.
كما نصت الفقرة (ب) من المادة (4) من ذات القانون على الاتي : يعاقب كل من أفسد نظام الحكم بالاشغال الشاقة المؤقتة او الحبس او الغرامة أو بهما. كما يحكم في الحالتين برد ومصادرة ما يكون كل متامر او مفسد قد افاده من تامره او افساده وتحدد المحكمة ما تحكم بمصادرته وتعين ما يجب رده كما يجوز لها أن تحكم بالتعويض المناسب..
2 تعديل نص الفقرة (ثانياً) من المادة (1) من قانون المحكمة الجنائية العراقية العليا رقم (10) لسنة 2005 لتكون ولاية المحكمة غير محددة لغاية (2003/5/1) من اجل تطبيق نصوص مواد القانون المذكور على حالات الفساد التي حدثت بعد هذا التاريخ .
